Quick answer

What insurance does a chiropractic clinic need in Ontario?

Ontario chiropractors must carry professional liability insurance of at least $5 million per occurrence and $5 million aggregate per year under College of Chiropractors of Ontario by-laws. The clinic also needs its own coverage: general liability, entity professional liability, property and equipment including x ray units, business interruption, cyber and, with staff, employment practices liability.

Practitioner coverage and clinic coverage are different

Under College of Chiropractors of Ontario by-laws, chiropractors must carry professional liability insurance of at least $5,000,000 per occurrence and $5,000,000 aggregate per year. That protects the individual chiropractor.

The clinic needs its own protection for premises injuries, equipment such as x ray units and adjustment tables, patient data and claims that name the business alongside the practitioner. Multi disciplinary clinics that add massage therapy, physiotherapy or acupuncture need coverage that reflects every service offered.

What coverage does a chiropractic clinic need?

These are the coverages a broker will usually build in.

Entity professional liability

Covers the clinic for treatment related claims that name the business, including care by associates, contractors and other practitioners in the clinic.

  • Associates and contractor chiropractors
  • Other disciplines in the clinic
  • Coordinated with individual policies

Commercial general liability

CGL covers the premises risks that practitioner malpractice policies do not: a patient slipping in the waiting room, a visitor tripping on a mat, or damage to your landlord's property. Most commercial leases require it.

  • Slips and falls in the clinic
  • Damage to the landlord's premises
  • Usually $2 million to $5 million

Property, equipment and business interruption

Your leasehold improvements, treatment equipment, furniture and inventory are the clinic's biggest physical assets. Property and equipment breakdown coverage protect them, and business interruption helps replace lost income if a fire, flood or equipment failure closes the clinic.

  • X ray and imaging equipment
  • Adjustment and decompression tables
  • Leasehold improvements

Cyber and privacy liability

Ontario clinics that hold personal health information are health information custodians under PHIPA and must notify patients, and in many cases the Information and Privacy Commissioner, after a privacy breach. Cyber insurance helps pay for breach response, notification, system recovery and lost income after a ransomware attack.

How much malpractice insurance do chiropractors need in Ontario?

College of Chiropractors of Ontario by-laws require at least $5 million per occurrence and a $5 million annual aggregate.

Does the clinic need insurance if every chiropractor has their own?

Yes. Individual policies protect the chiropractor. The clinic needs general liability, property and entity coverage for claims that name the business.

Is x ray equipment covered?

Property coverage protects it from fire and theft, and equipment breakdown covers mechanical and electrical failure. List high value equipment with your broker.

Do clinics need cyber insurance?

Most do. Clinics hold personal health information, rely on booking and billing systems, and are frequent ransomware targets. Under PHIPA, many breaches must be reported to patients and the Information and Privacy Commissioner, which costs time and money.

Does a clinic need employment practices liability?

It is worth considering. Clinics employ front desk staff and often engage practitioners as contractors, which can lead to wrongful dismissal, harassment or misclassification claims. EPL covers defence costs and settlements for those claims.

The Commercial Insurance Difference: Feedback from those referred

  • Proactive Broker Relationship.

The most noticeable difference was the fact that I no longer felt that I was needed to manage the broker... the brokers came to me with proactive recommendations and knew when to push and shop the market and when not to. When the topic of business insurance comes up, I always refer fellow business owners.

  • Security Blanket For My Business

I was always the type of customer that never believed in insurance and only really got it because I had to. Then I connected with a broker through Commercial Insurance.ca and they asked me questions no one else ever did and that's how I knew something was different. They took the time to understand and evaluate the risks. Well, I ended up getting some extra coverage (legal expense) and thank goodness I did. Something fairly innocent turned into something quite nasty and I didn't have to do too much... my coverage took care of it. Now I look at Insurance as a security blanket for my business.

  • They had my back

No one likes buying insurance because it's a bit of a bet against yourself. You just hope that when the bad things happen that insurance will do what it said it would do in the first place.  Their specialist stand behind the policy's that they bind. They never professed to get me the best price, but they did say they have my back, and have my back, they did.
