What is a WSIB clearance certificate?

A WSIB clearance certificate shows that a contractor or subcontractor is registered with the WSIB and their account is in good standing. In Ontario construction, principals must get a clearance before work begins and keep it current for the whole job. Clearances are valid for up to 90 days, and without one a principal may be liable for the contractor's unpaid WSIB amounts up to the labour value of the contract.

Why clearances matter in construction

Ontario's expanded compulsory coverage rules mean most people who own or run a construction business must have WSIB coverage, with or without employees. That includes independent operators, sole proprietors, partners and executive officers.

The WSIB requires principals to obtain a clearance from each contractor before construction work begins and to make sure a clearance stays in effect for the entire time the contractor is working. Without one, the principal may be liable for the contractor's payment obligations to the WSIB, up to the value of the labour portion of the contract.

Who must have WSIB coverage in construction?

The rules are broad, with two main exemptions.

Covered

  • Construction business owners with or without workers
  • Independent operators and sole proprietors
  • Partners and executive officers
  • All workers of construction employers

Exemption: home renovation

  • Independent operators, partners or executive officers
  • Doing home renovation work only
  • Hired directly by the homeowner
  • Workers must still be covered

Exemption: one non working officer

  • One executive officer or partner per company
  • Must not perform construction work
  • Site visits are allowed
  • Application to the WSIB required

Collect a clearance from every contractor and subcontractor before they start, check it again before it expires and before you pay, and keep copies with your project records.

A clearance is valid for up to 90 calendar days depending on when it is issued, and it can be renewed.

What happens if I hire a contractor without a clearance?

Without a clearance, the principal may be liable for the contractor's payment obligations to the WSIB, up to the value of the labour portion of the contract.

Do sole proprietors in construction need WSIB?

Yes, in most cases. Sole proprietors, independent operators, partners and executive officers in construction must have coverage unless an exemption applies.

Do homeowners need a WSIB clearance from their renovator?

Homeowners hiring directly for home renovation work are in a different position from commercial principals, and independent operators doing only that work may be exempt. Homeowners should still confirm the contractor is insured.

Is WSIB the same as liability insurance?

No. WSIB covers injuries to workers. Liability insurance covers injuries and damage to clients and the public. Contractors usually need both.
